1. Acceptance of Terms
By accessing and using It's Buzzing ("Service", "Platform", "we", "us", or "our"), you ("User", "you", or "your") accept and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our Service.
2. Service Description
It's Buzzing provides a comprehensive platform connecting businesses with customers through:
- Ambassador Referral Network: Facilitate introductions and referrals between ambassadors and potential customers
- BuzzCRM: Customer Relationship Management tools for contact management, lead scoring, and email campaigns
- Digital Business Cards: Buzziness cards with QR codes and digital wallet integration
- Rewards Management: Track and distribute rewards for successful referrals
- Analytics and Reporting: Track performance, engagement, and ROI
We facilitate connections and provide tools but do not directly provide services to end customers.
3. User Responsibilities
All users agree to:
- Provide accurate, current, and complete information during registration and use
- Maintain the confidentiality of account credentials and passwords
- Use the Service in compliance with all applicable local, state, national, and international laws
- Not use the Service for any unlawful or fraudulent purposes
- Not impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Not transmit any viruses, worms, or malicious code
- Report any suspicious activity, security vulnerabilities, or violations of these Terms
- Comply with CAN-SPAM Act, GDPR, CASL, and other applicable marketing and privacy regulations
4. Business and Ambassador Terms
Businesses and ambassadors using the Platform are responsible for:
- Accurate representation of services, products, and availability
- Professional conduct in all interactions with customers and other users
- Compliance with local business regulations, licensing requirements, and tax obligations
- Honest referral practices without false or misleading claims
- Respecting intellectual property rights of others
- Proper handling of customer data and privacy
- Timely payment of agreed-upon rewards and commissions
5. Third-Party Integrations
It's Buzzing integrates with third-party services to enhance functionality. By using these integrations, you also agree to the third-party's terms of service:
5.1 Google Services
- Google Workspace Integration: When you connect your Google account, we access Gmail (to send tracked emails), Google Calendar (to schedule appointments), Google Contacts (to sync contacts), Google Docs (to generate documents), and Google Slides (to create presentations). - Google Wallet: Digital wallet passes for Buzziness cards use Google Wallet API. See Google Wallet Terms.
- Data Access: We only access Google data you explicitly authorize via OAuth consent screen. You can revoke access anytime at Google Permissions.
5.2 Meta/Facebook Services
- Facebook Login: Optional authentication method using Facebook account credentials.
- Facebook Pixel: Tracks conversions and enables retargeting campaigns (if you opt-in to marketing).
- Data Sharing: Limited to authentication data and opt-in marketing tracking. See Facebook Terms.
5.3 Payment Processing
- Stripe: All payment processing is handled securely by Stripe. We do not store full credit card details. See Stripe Terms.
- Payment Terms: Subscriptions are billed monthly or annually in advance. Refunds are provided per our refund policy (see Section 11).
5.4 Rewards and Gift Cards
- Giftbit: Digital gift card rewards are fulfilled by Giftbit. See Giftbit Terms.
- Reward Availability: Reward options depend on third-party availability and may change without notice.
5.5 Other Integrations
- Mailchimp: Email list import/export functionality (optional).
- Render: Cloud hosting infrastructure. See Render Terms.
6. Data Privacy and Usage
Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.
6.1 Data We Collect
- Account Information: Name, email, phone number, business details
- Contact Data (BuzzCRM): Contact names, emails, phone numbers, engagement history
- Usage Data: Pages viewed, features used, performance analytics
- Cookies: Session management, analytics, and preferences (see Cookie Policy)
6.2 How We Use Data
- Provide and improve the Service
- Send transactional emails (account notifications, password resets)
- Facilitate referrals and track rewards
- Generate analytics and insights for your business
- Comply with legal obligations
6.3 Email Marketing and BuzzCRM
If you use BuzzCRM email campaign features:
- You are the data controller for contacts you import into BuzzCRM
- You must have lawful basis (consent, legitimate interest) to email contacts
- You must comply with CAN-SPAM, GDPR, CASL, and applicable anti-spam laws
- We provide unsubscribe functionality in all campaign emails
- You are responsible for honoring unsubscribe requests
7. Intellectual Property
7.1 It's Buzzing IP
The Service, including its original content, features, functionality, software, and design, is owned by It's Buzzing and is protected by copyright, trademark, and other intellectual property laws.
7.2 User Content
- You retain ownership of content you upload (business logos, images, marketing materials)
- You grant us a license to use, display, and distribute your content as necessary to provide the Service
- You represent that you have all necessary rights to the content you upload
8. Prohibited Uses
You may not use the Service to:
- Send spam, unsolicited emails, or engage in phishing
- Harvest or collect email addresses or other contact information of other users
- Upload viruses, malware, or any malicious code
- Impersonate or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers
- Violate any applicable laws or regulations
- Scrape, crawl, or use automated tools to access the Service without permission
9. Limitation of Liability
It's Buzzing acts as a platform and technology provider. We are not responsible for:
- The quality, availability, or pricing of services provided by businesses
- The accuracy or reliability of information provided by users
- Disputes between businesses, ambassadors, and customers
- Third-party integrations and their availability or data practices
- Loss of data due to user error, third-party failures, or force majeure events
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IT'S BUZZING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless It's Buzzing, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your email marketing activities conducted through BuzzCRM
11. Subscription and Refund Policy
11.1 Subscription Plans
- Free Plan: Limited features, no payment required
- Paid Plans: Billed monthly or annually in advance via Stripe
- Auto-Renewal: Subscriptions renew automatically unless canceled
11.2 Cancellation
- You may cancel anytime from Settings → Billing → Cancel Subscription
- Cancellation takes effect at the end of your current billing period
- No refunds for partial months or unused features
11.3 Refund Policy
- 14-Day Money-Back Guarantee: Full refund if you cancel within 14 days of your first payment
- After 14 Days: No refunds, but you can cancel to prevent future charges
- Annual Plans: Pro-rated refunds at our discretion for extenuating circumstances
12. Termination
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Suspected fraudulent, abusive, or illegal activity
- Prolonged inactivity (180+ days for free accounts)
- Non-payment of fees (for paid accounts)
- At your request
Upon termination, your right to use the Service will immediately cease. We may delete your data after 30 days, except as required by law.
13. Data Retention and Deletion
- Active Accounts: Data retained as long as account is active
- Canceled Accounts: Data retained for 30 days to allow reactivation, then deleted
- Legal Requirements: Some data (invoices, transaction records) retained for 7 years for tax/legal compliance
- Right to Deletion: You can request immediate data deletion by emailing sales@itsbuzzing.com
14. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Email to your registered email address (at least 30 days before changes take effect)
- In-app notification
- Updating the "Last Updated" date at the top of this page
Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
15.2 Arbitration Agreement
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California. You waive your right to a jury trial and to participate in a class action lawsuit.
15.3 Exceptions
Either party may bring a claim in small claims court if it qualifies. We may seek injunctive relief in court to protect our intellectual property rights.
16. Accessibility
We strive to make our Service accessible to all users. If you encounter accessibility barriers, please contact us at sales@itsbuzzing.com and we will work to address them.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
18. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and It's Buzzing concerning the Service.

It's Buzzing provides a referral platform and CRM tools. You're responsible for using the Service legally and ethically. We integrate with Google, Facebook, and other third parties (you agree to their terms too). We don't guarantee uptime or results. You can cancel anytime. Disputes go to arbitration.
